KNews.id- The government issued Government Regulation (PP) Number 34 of 2021 concerning the Use of Foreign Workers (TKA). This PP is a derivative of the Job Creation Act (UUCK).
In this PP, the government allows foreign workers to work in International Bodies to Government Agencies, including holding important positions as Directors and Commissioners.
However, the employer must follow the existing rules. If not, then there are looming sanctions, both administrative sanctions and fines. In article 37 paragraph 2, the value starts from Rp. 6 million to Rp. 36 million.
“The calculation of the amount of the fine as referred to in paragraph (2) shall be imposed on the TKA Employers starting from the time the TKA enters Indonesian territory for up to 6 (six) months,” writes article 37 paragraph 3.
In article 37 paragraph 5, the TKA Employer must pay a fine not later than two weeks from the receipt or announcement of the imposition of the fine.
