OJK Refuses to Postpone Kresna Life Insurance Debt, Check The Explanation!

KNews.id- Deputy for Communications of the Financial Services Authority (OJK) Anto Prabowo emphasized that the OJK has never submitted a Request for Postponement of Debt Liability (PKPU) against PT Asuransi Jiwa Kresna to the Court.
Anto said, the OJK actually never approved a request from any party to apply for PKPU against Kresna Life. The request for Postponement of Debt Liability (PKPU) was submitted by the applicant on behalf of Lukman Wibowo, represented by Legal Advisor Benny Wullur S.H & Associates to PT Asuransi Jiwa Kresna (AJK).
"In accordance with article 50 of the Insurance Law No. 40/2014 and its explanation states that applications for bankruptcy statements against Insurance Companies, Sharia Insurance Companies, reinsurance companies, or sharia reinsurance companies based on this Law can only be submitted by the Financial Services Authority," said Anto in Jakarta. , Wednesday (23/12).
Just to note, the Central Jakarta District Court determined that the company was in PKPU status for 45 days from December 10, 2020. In OJK's records, there are two PKPU applications against PT AJK that were submitted to OJK and both have been rejected by OJK. The request is regarding a request from JG Law Firm representing the applicant on behalf of Lie Herton and Rudy Kartadinata through a letter dated August 6, 2020 regarding the Application for Postponement of PT Asuransi Jiwa Kresna's debt payment obligations.
Then an application from the Benny Wullur SH & Associates Law Office representing 15 (fifteen) PT Asuransi Jiwa Kresna policyholders through a letter dated 11 August 2020 regarding the PKPU Permit Application for PT Asuransi Jiwa Kresna. Regarding this issue, OJK has invited the Board of Directors of PT AJK to ask for an explanation regarding the follow-up of PKPU's legal efforts to be carried out by PT AJK.
"Regarding this issue, OJK has invited the Board of Directors of Kresna Life to ask for an explanation regarding the follow-up of PKPU's legal efforts to be carried out by Kresna Life. On this occasion, the Board of Directors of Kresna Life expressed an attitude that essentially objected to the decision in question, "said Anto.
However, the management has objections because the company has negotiated the settlement of obligations to policyholders. As of Friday (18/12), Kresna Life is known to have received mutual agreement approval for 8,054 policies or 77.61 percent of the total policies, for liabilities of IDR 3.85 trillion or 55.76 percent of total liabilities. The company has also begun to pay its obligations to policyholders amounting to Rp283.60 billion for 5,672 policies.
"Following up the meeting with Kresna's management, OJK submitted a letter asking Kresna Life to take legal measures against the court's decision, including extraordinary legal remedies, in accordance with statutory provisions," said Anton. (AHM)
