Jokowi and Alleged Abuse of Power in The Corruption Case of Social Assistance Funds

By: Ahmad Khozinudin, S.H. Advocates, Activists Fighting the Khilafah
KNews.id- After the findings of the Tempo magazine investigation which stated that Gibran Rakabuming Raka was suspected of being involved in corruption and social assistance to tackle the Covid-19 pandemic, of course the public deserves to ask questions. Is President Jokowi involved in the disgrace of corruption in the midst of this shameful pandemic?
Because anyone will surely have a conclusion, Gibran's recommendation to PT Sritex as the party appointed to hold the goodie bag, certainly not because of his personal capacity. However, because of "his position" as "the son of the village head".
Therefore, it should be further investigated whether the decision to appoint PT Sritex as the party that organized the goodie bag was purely due to the "intervention" of the Head of the Village, or there was a direct influence from the Head of Village. Because, it's a little hard to believe if that influence only relies on the capacity of a Gibran. Although a fellow PDIP cadre, Gibran was a child yesterday afternoon.
Thus, it does not have the capacity to "Influence Juliari Peter Batubara" who is more senior than him. Gibran also did not hold a structural position in the PDIP, which because of that position was able to have a structural "pressure" effect on Juliari Peter Batubara, his PDIP colleague. Simply selling the name as the son of the Head of the Village, is also a bit difficult to do without a certain "action" from the Head of the Village.
Therefore, the KPK is not only obliged to follow up on Tempo's findings by summoning Gibran Rakabuming Raka, it is also obliged to investigate whether the Lurah's influence, in this case President Jokowi, led to the decision to appoint PT Sritex.
This can happen directly, or indirectly using the role of a mediator. This is because, in the provisions of Article 2 of the Anti-Corruption Act, it is stated: "Any person who violates the law who commits an act that enriches himself or another person or corporation that can harm the state finances or the state economy, is sentenced to imprisonment with life imprisonment or a minimum imprisonment of four years. and a maximum of 20 years and a fine of at least Rp. 200 million and a maximum of Rp. 1 billion.
"As for article 3, it states:" Every person who aims to benefit himself or another person or a corporation, misuses his / her authority, opportunity or existing means because a position or position that can harm the State's finances or the country's economy, shall be punished with a life imprisonment or imprisonment for a minimum of 1 year and a maximum of 20 years and an imprisonment of at least Rp. 50 million and a maximum of Rp. 1 billion.
" The corruption of Bansos funds certainly benefits people or corporations.
The corruption of Bansos funds is of course carried out by an act that is against the law. The corruption of Bansos funds is of course carried out with an act that abuses authority. The corruption of Bansos funds is of course detrimental to the State's finances, although to ensure it must be audited by the BPK.
What is clear, it is necessary to investigate the alleged involvement of the President on the findings of the facts reported by Tempo Magazine in connection with Gibran Rakabuming Raka's recommendation to PT Sritex. Was there any action by the President who committed an illegal act in the case?
Was there any contribution by the president by abusing authority in the case? This is important to know, because if this happens it could have implications for the activation of article 7A of the 1945 Constitution, which states: "The President and / or the Vice President can be dismissed during their term of office by the People's Consultative Assembly at the suggestion of the House of Representatives, whether proven to have violated the law. in the form of treason against the state, corruption, bribery, other serious crimes, or despicable acts or if proven no longer fulfilling the requirements as President and / or Vice President.

"Corruption during a pandemic is certainly a very despicable act. Covering up this despicable act is even more despicable. Therefore, the KPK is obliged to reveal this case so that it can be made publicly known. (AHM)
