Finally, MK Rejects Presidential Threshold Lawsuit!

KNews.id- The Constitutional Court (MK) decided to reject the lawsuit for judicial review of Law (UU) Number 7 of 2017 concerning Elections. One of the lawsuits related to the Presidential Threshold was filed by former TNI Commander Gatot Nurmantyo.

“The decision to adjudicate, states, the applicant’s application cannot be accepted,” said Chief Justice of the Panel of Judges Anwar Usman when reading the verdict online, Thursday (24/2).

“This was decided in a deliberation meeting of judges by 9 constitutional judges, namely Anwar Usman as chairman and concurrently member,” he said.

To note, in the main point of his petition, Gatot asked the Constitutional Court to declare Article 222 of Law Number 7 of 2017 concerning Elections contrary to the constitution. Gatot considered that the regulation was contrary to Article 6 paragraph (2), 6A paragraph (2), and 6A paragraph (5) of the 1945 Constitution.The article stipulates that nominations for president and vice president must be supported by political parties or a combination of political parties with a minimum of 20% of the seats in the DPR or 25% of the national valid vote. Gatot revealed the importance of submitting a discussion on the presidential threshold as a continuation of Indonesia’s democracy going forward.

He considered that if you maintain 20% of PT, then it is the same as providing an opportunity for oligarchic politics and the politics of trade-offs to buy and sell candidates.

“Stating Article 222 of Law Number 7 of 2017 concerning General Elections (State Gazette of the Republic of Indonesia of 2017 Number 182, Supplement to the State Gazette of the Republic of Indonesia Number 6109) is contrary to the 1945 Constitution and has no binding force,” said Gatot in his petition.

Apart from Gatot, there were 5 other applicants who requested the abolition of the presidential threshold. Among them, Gerindra Party politician Ferry Juliantono, several members of the DPD RI including Tamsil Linrung and Fahira Idris. (AHM/sindow)
